1. Acceptance of Terms

By downloading, installing, or using Smart Call Assistant ('the App'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, do not use the App.

2. Description of Service

Smart Call Assistant is a mobile application designed to:

  • Monitor incoming phone calls in real-time
  • Detect repeat calls from the same phone number within a 5-minute window
  • Automatically override silent mode to enable ringtone for important calls (2-3 calls from the same number within 5 minutes)
  • Restore silent mode after the call ends

The App operates locally on your device and does not require an internet connection for core functionality.

3. License Grant

3.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

3.2 Restrictions

You may not:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices from the App
  • Use the App for any illegal or unauthorized purpose
  • Rent, lease, sell, or sublicense the App to third parties
  • Use the App in a manner that violates any applicable laws or regulations

4. User Responsibilities

4.1 Permissions

You are responsible for granting the App necessary permissions to function:

  • Phone state access (to detect incoming calls)
  • Call log access (to track repeat calls)
  • System audio override (to enable ringtone when in silent mode)
  • Background processing and notifications

4.2 Device Compatibility

You acknowledge that:

  • The App requires Android 6.0+ (API 23+) or compatible iOS version
  • Functionality may vary based on device manufacturer, OS version, and system settings
  • Some features may not work on devices with aggressive battery optimization or custom ROM modifications

4.3 Proper Use

You agree to:

  • Use the App only for its intended purpose (detecting important repeat calls)
  • Not interfere with or disrupt the App's operation
  • Not attempt to bypass any security or detection mechanisms

5. Platform-Specific Terms

5.1 Android

  • The App uses system-level services to monitor calls and override silent mode
  • Certain device manufacturers (Xiaomi, Huawei, Samsung, etc.) may have additional battery optimization settings that affect background operation
  • You may need to manually configure permissions and battery settings for optimal performance

5.2 iOS

  • Due to Apple's platform restrictions, ringtone override functionality may be limited or unavailable
  • The App may use alternative notification methods (loud notifications) instead of ringtone override
  • CallKit functionality is subject to Apple's API limitations
  • Background call monitoring operates within iOS system constraints

6. Privacy and Data

6.1 Local Storage

All call data is stored locally on your device. The App does not transmit your data to external servers or third parties.

6.2 Data Retention

Call log data is automatically deleted after 24-48 hours. Uninstalling the App permanently removes all stored data.

6.3 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Disclaimer of Warranties

7.1 'AS IS' Basis

THE APP IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees of uninterrupted, error-free, or secure operation
  • Accuracy or reliability of call detection

7.2 No Guarantee of Functionality

We do not guarantee that:

  • The App will detect 100% of repeat calls in all scenarios
  • Ringtone override will work on all devices and configurations
  • Background services will survive all system-level battery optimizations or app kills
  • The App will be compatible with future OS updates or device models

7.3 Third-Party Dependencies

The App's functionality depends on system-level APIs and permissions. Changes to operating system behavior, security policies, or device restrictions may affect the App's performance.

8. Limitation of Liability

8.1 No Liability for Missed Calls

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Missed important calls due to App malfunction, system restrictions, or detection failures
  • Any direct, indirect, incidental, consequential, or special damages
  • Loss of data, business interruption, or lost profits
  • Damages arising from device incompatibility or OS updates

8.2 Maximum Liability

Our total liability for any claims related to the App shall not exceed the amount you paid for the App (if applicable) or $10 USD, whichever is greater.

9. Important Call Detection Limitations

9.1 Detection Logic

The App uses a simple rule-based detection system:

  • Detects when the same phone number calls 2-3 times within a 5-minute window
  • No AI, machine learning, or predictive algorithms are used

9.2 Limitations

You acknowledge that:

  • Different callers using different phone numbers will not trigger the detection
  • Blocked or unknown numbers may not be detected properly
  • System-level call blocking or spam filtering may interfere with detection
  • Emergency calls should not rely on this App for alert notification

9.3 Not a Replacement for Emergency Services

THE APP IS NOT DESIGNED FOR EMERGENCY USE. DO NOT RELY ON THE APP TO ALERT YOU TO EMERGENCY CALLS. ENSURE YOUR DEVICE'S EMERGENCY CALL FEATURES ARE PROPERLY CONFIGURED.

10. Background Service and Battery Usage

10.1 Battery Consumption

The App runs a background service to monitor calls continuously. While optimized for minimal battery usage:

  • Battery drain may vary by device, OS version, and usage patterns
  • We target <2% battery consumption per day, but results may vary
  • You may need to exempt the App from battery optimization settings

10.2 Background Processing

The App requires background processing permissions to function. Disabling background services will prevent the App from detecting calls.

11. Updates and Modifications

11.1 App Updates

We may release updates to improve functionality, fix bugs, or comply with OS changes. You are responsible for keeping the App updated.

11.2 Terms Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting with an updated 'Last Updated' date. Continued use of the App constitutes acceptance of modified Terms.

11.3 Service Discontinuation

We reserve the right to discontinue the App or any features at any time without prior notice.

12. Termination

12.1 By User

You may terminate your use of the App at any time by uninstalling it from your device.

12.2 By Us

We may terminate or suspend your access to the App immediately if you violate these Terms.

12.3 Effect of Termination

Upon termination, all licenses granted to you will immediately cease, and you must stop using the App.

13. Intellectual Property

The App, including all code, designs, algorithms, and documentation, is owned by us and protected by copyright and intellectual property laws.

13.2 Trademarks

'Smart Call Assistant' and any associated logos are our trademarks. You may not use them without our written permission.

14. Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws and regulations when using the App, including:

  • Device usage policies

15. Indemnification

You agree to indemnify and hold harmless the App developers, affiliates, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Violation of these Terms
  • Violation of any third-party rights
